PRIVACY STATEMENT
This privacy statement explains how John Miller Law handles your personal information. We comply with the Privacy Act 2020 and acknowledge the importance of handling your information with care and respect.
Collecting Information
To represent you effectively, we may need to collect information from you as well as obtaining your personal information from other agencies. This information will include contact and identification details (date of birth etc.), and personal information relevant to your case.
We will only obtain information as authorized by signed Authority to Act. Further, we will only request information that we assess as being relevant to your particular case. What this information is depends on the area of law for which we are providing legal services.
Accident Compensation
For ACC cases, we collect ACC claim documents; as well as records from treatment providers which may include General Practitioners (GPs), Private Specialists, Te Whatu Ora (Public Health System), Physiotherapists, Chiropractors, Osteopaths and other therapists. We may collect information from other sources, as authorised by you.
If your case involves weekly compensation, we may collect payment information from IRD, Employers and/or WINZ.
Mental Health
If we are acting for you under the Mental Health (Compulsory Treatment and Assessment) Act 1992 we receive mental health records such as court reports from your mental health treatment team. If needed, we may also request further mental health, medical records and other records as authorized by you.
Criminal Law
For criminal law matters, we receive disclosure from the NZ Police. We may also collect medical records and other relevant information as authorised by you.
MSD Historic Claims
To assist with Historic Claims matters we may collect documentation from healthcare providers, government agencies and faith-based institutions as required by the circumstances of the claim.
Sharing your information
To represent you effectively we may share your personal information with: people and organisations to whom you have authorised; experts we engage to provide evidence to support your case; other parties in the proceeding (for example ACC); and the Court or Tribunal deciding your case.
Any disclosure of information will be in accordance with the Privacy Act 2020 and our obligations under the Rules of Conduct and Client Care for Lawyers.
Accessing and correcting your information You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong.
